HIPs Update - 12th June 2007

WHY USE SARGINSONS HUGHES & MASSER TO PROVIDE YOU HIP

1. We are regulated by the Solicitors Regulation Authority and we are insured if things go wrong. Companies claiming to be HIP providers are not regulated in any way.

2. Some Estate Agents will need and provide a HIP on the basis that payment can be made when the property is sold, If your property does not sell and you wish to instruct another agent you will then have to pay for the HIP. The new agent may well insist on similar conditions requiring another HIP. If SH&M prepare the HIP it will always belong to you and you will not be charged if you change Estate Agents.

In an uncertain market of expected interest rate rises following the introduction of HIPs you will be in a most favourable position if you own a HIP

In May 2007 the Royal Institute of Chartered Surveyors challenged the Government's policy on the introduction of Energy Performance Certificates (EPCs). As a result Ruth Kelly the Minister for Communities and Local Government announced in the House of Commons on 22nd May 2007 the following changes:

  • The introduction of HIPs and EPCs will be delayed from 1st June 2007 until 1st August 2007.
  • From the 1st August 2007 a HIP including the EPC will only be required on the sale of houses with four bedrooms or more. HIPs for smaller properties will be phased in at an unspecified time in the future.
  • Until the end of 2007 where a HIP is required an owner can market their property even though a HIP is not in place provided one has been commissioned.
  • Under the previous regulations the EPC needed to be carried out within a period of three months from the first point of marketing. This is now extended to twelve months.

The Government has stated that it will issue detailed regulations on these points as soon as possible.

SH&M can produce your HIP in paper and electronic form in one document. The electronic document can be sent to you, your agents and prospective purchasers in one file.
