Due to a recent change in the law the commission of the offence of using a mobile phone whilst driving brings about not only the imposition of a fine but also of 3 penalty points. With that of course comes the dangers of the loss of a driving licence through the totting up process subject to any successful argument of exceptional hardship. Any such prosecution might also open the possibility for a driver to argue Special Reasons to obviate the application of penalty points.
